Message from our memberAs you never answer to my questions and remarks, I guess you may be dont’ understand the french language very well.As I don’t speak german, I’ll try in english.So I remind you that, under supervision of a third party, I sent all books and DVD’s in a perfect state.All names on the list were sent.First of all, there is a gap of one day between the day/hour confirmed for your receip by Mondial Relay and your own confirmation.Than, I received a second confirmation message from you, still a little bit later.And there is another gap of two days (total 3 days) before you mentioned a rejected book because of damages and that two others books were missing.When I didn’t accept that two books were missing, you first wrote to me several « automatical replies » confirming the situation…. Before to recognize (as I insisted) a malfunction by you.Following your message, the two missing books were in fact lost by you…This recognition was finaly made after you certified to me that there was no place for a dispute, as two independant people had verified the package.Please note that, even you recognized to have to pay for the « missing » books, the situation in my account didn’t change. The sole solution offered in my account is to declare « not to send the books ».Than it remains the case of the « damaged » book.Please remind that the packaging was realized under the control of a third party and that all pieces sent were in good conditions.The said damaged book was part of a serie, all in the same state. The others were accepted.As you never requested the warranty from Mondial Relay, that means that you considered that no dammage happened during the transport.So, the unique possibility is that the dammage happened during a malfunction by you ( sure the same recognized for the two missing books).You recognized yourself that your process wasn’t a warranty of truth and reality !That’s the reason why I claimed (since about two months) the full payment for all pieces sent, including the said « missing and damaged books ».From another point of view, I have to remark that your way of working is a «one way » process : - You decide without any third control what is damaged or not- You never explain why, for a determinated case, what was happening- You never communicate any evidence in relation with your rejection- And the customer has to pay to get the rejected piece back, so he has to pay to get any evidence.Such rules, I mean « all rights for you and no right for the customer » seem to be illegal.That’s also why I requested the help of the Belgian Association of Consumers through their legal department.I hope to finally get the full payment of all pieces sent, as I can prove to have sent all pieces listed, and all in good conditions.Regards, Serge Decleer
